BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MONTGOMERY, ALABAMA as follows:

    SECTION 1.  That the Zoning Ordinance of Montgomery, Alabama, adopted September 17, 1963, be amended by removing the following described property from a B-2 (Commercial) Zoning District to an R-65-s (Single-Family Residential) Zoning District.

Lot 11, Block 6, according to the Re-Plat of Open Acres as said Plat appears of record in the Office of the Judge of Probate of Montgomery County, Alabama, in Plat Book 9, at Page 12.  LESS AND EXCEPT the Northeasterly 74’ of said Lot bordered by Lower Wetumpka Road and Pinecrest Street.

    SECTION 2.  This ordinance shall take effect upon its passage, approval and publication, or as otherwise provided by law.

    Default having been made in the payment of the principal debt secured by mortgage executed by Alicia Scott, in favor of Robert Martinet and David Herman, dated July 15, 2020,  and recorded in RLPY 5416 at Page 0522, in the Office of the Judge of Probate of Montgomery County, Alabama, the indebtedness being secured by said mortgage is due and payable and said mortgage is  subject to foreclosure. Notice is hereby given that under the Powers of Sale as provided in said mortgage, the undersigned  will on July 29, 2021, during the legal hours of sale, sell at public outcry to the highest bidder for cash before the courthouse door, in the City of Montgomery, County of Montgomery, State of Alabama, the following real estate described in and conveyed by said mortgage, the same  being situated in Montgomery County, State of Alabama, described as follows, to-wit:

Lot 18, Block 6, of Gardendale Estate No. 1, as the Plat thereof  appears of record in the Office of the Judge of Probate of Montgomery County, Alabama, in Plat Book 12, at page 138.
